Terms and Conditions:  Red Bull Symphonic Social Media Competition

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY

  1. Introduction and agreement to be bound 
    1. The Promoter is running the Competition for the purposes of promoting its services to existing and potential customers in South Africa and for this purpose creating publicity related to the Competition.
    2. These Terms and Conditions(“T&Cs”) apply to the Red Bull Symphonic Social Media Competition and all information and materials related thereto as set out in these T&Cs (the "Competition").
    3. Should you choose to participate in any element of the Competition, you are deemed to have agreed to be bound by these T&Cs.
    4. These T&Cs may contain provisions that limit the Promoter’s and/or third parties’ liability towards you, place certain assumptions of risk on you (including certain undertakings and indemnifications) towards Visa and/or other third parties, and record certain admissions of fact.
    5. Nothing in these T&Cs is intended to contravene the Consumer Protection Act, 2008 or any similar legislation. These T&Cs must be treated as being qualified, to the extent necessary, to ensure compliance with all applicable laws.
  2. Promoter 
    1. This promotion is conducted by Visa International Service Association, registration number 802339, together with its appointed agencies, and any nominated fulfilment agency identified to winners during prize administration with its supporting third-party providers ("collectively, the Promoter"). TikTok, Instagram, META do not sponsor or endorse this Competition. TikTok, Instagram, and Meta assume no responsibility for this Competition and have no control over the Competition or the Prizes.
  3. Competition Period 
    1. The Promotion will commence on 9 June 2026 and will run until 12 June 2026 at 12:00(CAT), unless extended or amended in accordance with applicable law and regulatory requirements. Entries outside the Promotion period will not be considered.
    2. If you entered the Competition but wish to opt out of the Competition, you are required to contact the Promoter as provided for in these T&Cs in writing, before the Closing Date.
  4. Eligibility 
    1. The Competition is only open to citizens and legal residents of South Africa, who (i) are 18 (eighteen) years old or older (with legal capacity) at the time of entering the Competition, (ii) reside in South Africa at the time of entering the Competition and of winning or receiving any prize in the Competition,  and (iii) who have a valid South African identity document or passport, or a legal residency permission (“Participants”) at time of entering the Competition and of winning or receiving any prize in the Competition.
  5. People prohibited from entering / Competition Disqualification 
    1. The following persons are prohibited from entering the Competition (“Disqualified Persons”):
    2. any person who is a director, member, partner, employee or agent of, consultant of the Promoter, Visa or supplier of goods or services in connection with the Competition (“Associates”);
    3. any other person who directly or indirectly controls, is employed by, or is controlled by the Promoter or Visa; and/or
    4. Any immediate family members of Associates who are indirectly or directly connected to, or employed by, any party in the aforementioned capacities or relationships, and each of their affiliates.
    5. Other Means of Disqualification: Any entries that are incomplete, unclear, submitted incorrectly, submitted after the Closing Date, or which contain errors or false information, or which are received from Disqualified Persons, will be regarded as invalid. Further, if a Participant breaches any of the T&Cs, or if the Promoter finds any wrongdoing on the part of the Participant (such as fraud, or cheating which will include manipulation of code or falsifying data), then the Participant will automatically be disqualified from participating in the Competition, and may also be banned from participating in other competitions/campaigns the Promoter may run in the future.
    6. Restricted videos: The Promoter reserves the right to disqualify any entry which, in its sole discretion, is inappropriate, including anything that is or can be interpreted to be racist, sexist, discriminatory, offensive, insensitive, hate or violence-inciting, or that may bring the Promoter into disrepute, or which may be considered to be in breach of clauses 6.4 and 10.2 below. The Promoter’s decision in this regard will be final.
  6. How to enter 
    1. To enter the Competition, participants must comment on, and interact with, the official Competition post published on the Visa South Africa Instagram, Facebook and TikTok social media pages during the Competition Period by:
      1. Engaging with polls or content pieces relating to the competition
      2. Sharing your “I made it” story in the comments.
      3. Tagging Visa in all UGC content
      4. Must follow our page
      5. Must “like” and reshare our content
    2. Entry Limitations
      1. Only one (1) entry per person and per social media account shall be accepted during the Competition Period. Duplicate entries by the same person or via the same social media account (whether on the same social media platform or on different platforms) shall be disqualified.
      2. As participation in the Competition is based on posting a comment on Instagram, TikTok or Facebook, each participant must use a personal, active and public social media account that is personally operated. Accounts that are private, inactive, automated, commercial, or otherwise not operated by a real individual shall not be considered valid for participation.
      3. Participants who do not meet these eligibility requirements shall not be eligible to participate in the Competition or to be selected in the prize draw.
      4. The Promoter reserves the right, at its sole discretion, to verify the eligibility of participants and to disqualify any entry that appears to have been submitted through fake accounts, bots, automated means, or any social media account that does not comply with these Terms and Conditions.
    3. Content Guidelines
      1. All entries must comply with the following content guidelines. Entries that fail to comply shall be disqualified at the Promoter’s sole discretion:
        1. Entries must be in the English language.
        2. Entries must not contain any content that is defamatory, obscene, vulgar, offensive, discriminatory, endorse any form of hate or hate group or be hateful, abusive, harassing or threatening, sexually explicit or suggestive, derogatory of any ethnic, racial, gender, religious, professional or age group, promote alcohol, illegal drugs, tobacco, tobacco substitutes, firearms/weapons (or the use of any of the foregoing), promote any particular political agenda or message, or otherwise unlawful;
        3. Entries must not infringe the intellectual property rights (including copyright), privacy rights, rights to dignity, or any other rights of any third party;
        4. Entries must not contain any advertising or promotional material, or any commercial solicitation;
        5. Entries must not contain any content that could damage the reputation or image of the Promotor, the VISA brand, FIFA or their respective partners.
      2. By submitting an entry, each participant represents and warrants that their entry does not contain any content specifically prohibited in clause 6.3.1.2 above.
      3. Entries that do not comply with the requirements set out in these T&CS, Promotor’s rules or policies, or that violate any social media platform rules or applicable law may be disqualified at the Promotor’s sole discretion.
      4. The Promoter reserves the right to disqualify any participant who tampers with the entry process, engages in fraud, uses automated means to enter the Competition, creates multiple or false accounts, violates or attempts to circumvent these T&Cs, as determined by the Promoter in its sole discretion.
      5. All decisions of the Promoter in connection with the Competition, including eligibility, disqualification, interpretation of these T&Cs and winner selection, shall be final and binding, not subject to any appeal.
    4. Free Participation
      1. No purchase is required to enter the Competition or win any prize. Participation in the Competition is entirely free of charge.
    5. Acceptance of Rules
      1. By entering the Competition, participants represent and warrant that they meet all eligibility requirements and agree to be fully and unconditionally bound by these T&Cs. Participants further agree that the decisions of the Promoter regarding the Competition shall be final, binding and not subject to appeal in all matters relating to the Competition.
  7. Selection Process 
    1. The draw will take place on 12th of June 2026 from verified entries via a selection process.
    2. The random draw shall be conducted in accordance with the requirements of the Consumer Protection Act, 2008, under the supervision of the Promoter and its appointed representative using a certified random selection tool, and a written record of the draw shall be kept on file.
    3. The identification of winners will be carried out, and the winner shall be selected as follows:
      1. The Promoter shall first select a shortlist of twenty (20) potential winners by random draw from all valid entries received during the Competition Period;
      2. The entries received on the social media accounts of the shortlisted participants shall then be reviewed by the Promoter to verify the validity of the relevant entries and compliance with these T&Cs.
      3. The first shortlisted participant whose entry passes verification shall be confirmed as the preliminary winner (hereinafter the “Nominee”).
    4. Notification
      1. The Nominee shall be contacted via Instagram, Facebook or TikTok direct message within five (5) business days of the draw. The Nominee must respond within the first forty-eight (48) hours of the initial contact attempt by the Promoter confirming its acceptance of the opportunity to accept the Prize, or its rejection of the opportunity to accept the Prize.
      2. If the Nominee cannot be contacted, is ineligible, fails to respond within the above timeframe after two (2) follow-up attempts to contact the Nominee, or declines the opportunity to accept the Prize, the next eligible shortlisted participant shall be selected as an alternate nominee, under the same conditions.
      3. Any participant selected during the draw or selection process shall be deemed a nominee only. A nominee shall not be considered a confirmed winner and shall not acquire any right to the Prize unless and until all eligibility, verification and confirmation requirements under these T&Cs have been fully satisfied, as determined by the Promoter.
  8. Prizes Description 
    Participants stand a chance to win:
    1. 1 of 20 pairs of Red Bull Symphonic tickets in Johannesburg at the Montecasino outdoor events area
    2. Nominee verification
      1. The Nominee must, within the timeframe specified by the Promoter:
      2. Provide proof of identity and age (valid ID or passport);
      3. Provide proof of residency in South Africa;
      4. Sign an affidavit of eligibility, liability release, and publicity consent;
      5. Sign a ticket receipt confirmation note and take a photograph of the prize tickets upon receipt.
        Failure to provide the required documentation within the specified timeframe shall result in automatic forfeiture of the prize.
    3. Prize Conditions
      1. The prize is non-transferable, non-exchangeable and cannot be redeemed for cash or any other consideration, unless the Promoter determines otherwise in writing. The Promoter reserves the right to substitute the prize with a prize of equal or greater value if the original prize becomes unavailable for any reason beyond the Promoter’s reasonable control.
      2. Travel requirements: The winner shall be responsible for his/her/ their own travel arrangements and subsequent costs to the venue
  9. General Conditions
    1. Liability and Indemnity: To the maximum extent allowed by law, the Promoter and any associated companies, including Visa, will not be responsible for any loss or damage suffered by any Participant or any other person in connection with participation in the Competition, the Competition or a Prize. You agree to indemnify the Promoter (including its officers, employees, agents, affiliates, associated companies, advertising agencies, advisers and suppliers) against, and hold the foregoing persons harmless from any damages, liabilities, losses, or expenses incurred or arising directly or indirectly out of your participation in the Competition, the use or acceptance of any Prize, your breach of these T&Cs (including any warranty in relation to intellectual property and third party rights), or other act or omission in relation to the Competition or a Prize.
    2. Trademarks and brand names: The trademarks, logos and service marks, whether registered or unregistered (collectively the "Trademarks") used by the Promoter in connection with the Competition are Trademarks of Visa and others. Nothing in these T&Cs or participation in the Competition should be construed as granting by implication, estoppel, or otherwise, any licence or right to use any Trademark without the prior written permission of the Promoter or such third party that may own the Trademark. The unauthorised use of any Trademarks or any other content used by the Promoter in connection with the Competition is prohibited.
    3. Publicity: The Promoter may ask you to be identified, recorded, or photographed and to have the photographs or recordings published in various media, including print and web-based media, for purposes of the Competition or for the business of the Promoter. Further, the Promoter may ask to use your image for marketing purposes, without any payment to you. You may decline these requests. Where you agree to such request, you agree to grant the Promoter an irrevocable, perpetual, world-wide, transferable, royalty-free right to use, reproduce, display, adapt and publish the Elevator Pitch video to any medium, most notably the Promoter’s websites and social media pages.
    4. Third Party Sites: The Promoter is not responsible for the acts, content or privacy policies of any third-party websites or platforms that may be associate with, or in any way linked to the Competition or the Prizes. Participants shall still be bound by any terms and conditions related to the use of third-party websites or services, including TikTok and Takealot.
    5. Cancellation and Changes: The Promoter may cancel, suspend or make changes (substitutions) to the Competition, the T&Cs or Prizes at any time, where the Promoter believes that the change or cancellation is necessary or where matters which are outside of the control of the Promoter may occur. Any changes will be posted either within the Competition information, or these T&Cs, or such other media selected by the Promoter and will become effective immediately after being made, or on a date indicated by the Promoter. You will not have any claim against the Promoter because of the changes in the T&Cs or the Prizes.
    6. Technical failures and unauthorized intervention: The Promoter is not responsible for any problems or technical fault of any telephone network, online systems, servers, equipment, software, failure of any e-mail or entry to be received by the Promoter on account of technical problems, human error or traffic congestion on the internet or at any web site, or any combination of these things, including any damage to your computer, resulting from your participation in this Competition or your downloading any materials in this Competition.
    7. Data Privacy: By participating in the Competition, you confirm that all information provided by you is true and correct. Further, you consent to the transfer, storage and processing of your personal information, which may include the sharing of such personal information with third parties. The Promoter and its affiliates will collect and use your personal information (a) to enable your participation in this Competition; (b) for activities related to this Competition; and (c) for purposes related to the Promoter’s business operations. The Promoter will process and retain your personal information to fulfil the purposes for which it was collected and/or as is required by applicable laws or regulations and in accordance with (but not limited to) the Visa Global Privacy Notice. You further agree that your personal information may, in appropriate circumstances, reside outside of South Africa, and hereby agree to the transfer of your personal information to locations outside of South Africa and the use of your personal information in such locations as described in this clause. You may withdraw your consent/s under this clause, in whole or in part, at any time by written notification to the Promoter.     8. Waiver: The Promoter’s failure to enforce any of these T&Cs shall not constitute a waiver of its right to do so.
    9. Disputes: The decision of the Promoter in respect of any disputes arising out of this Competition shall be dealt with by the Promoter in terms of these T&Cs and shall be final. These T&Cs are governed by the laws of South Africa.
