Terms and conditions for the Visa Tap iVisa Uvaye FIFA World Cup 26™ promotion in South Africa

These Terms and Conditions ("T&Cs") are prepared and presented in accordance with the Consumer Protection Act 68 of 2008 ("CPA") and its Regulations, as well as the Protection of Personal Information Act 4 of 2013 ("POPIA").

This Promotion is conducted in compliance with Section 36 of the CPA and Regulation 11 of the CPA Regulations. Any provision of these T&Cs that is inconsistent with the CPA shall be void to the extent of such inconsistency.

Please read the below Terms and Conditions carefully. By participating in this Promotion, you agree to comply with the Terms and Conditions set out below. If you do not agree with these Terms and Conditions, please do not participate in this Promotion.

The TAP IVISA UVAYE FIFA World Cup 26TM (“Promotion”) is conducted by Publicis Publicis Machine Agency (“Promoter”) together with its third-party providers. All Participants during the term of this Promotion agree to be bound by the following T&Cs:

1. Duration of Promotion

  • This Promotion will run from 15 May – 23 May 2026 at 23h59 (“the Promotion Period”) and is open to all eligible South African based residents who are VISA cardholders in South Africa and are 18 years or older and have a valid passport (with no less than 6 months until expiry date).

2. To enter the Promotion, participants must:

  • To enter this Promotion, eligible participants must complete ALL of the following steps during the Promotion Period 15 May – 23 May 2026 at 23h59
    • Make a minimum of one (1) qualifying transactions using your Visa card, each transaction being for an amount of no less than R1,500.00 (one thousand five hundred rand), during the Promotion 15 May – 23 May 2026 at 23h59
    • Retain proof of each qualifying transaction (till slip or electronic transaction record);
    • Register on visa.co.za/TapiVisaUvaye by providing your first name, last name, email address, and mobile phone number; and
    • Verify your Visa card by entering the last four (4) digits of your Visa card number (NOT your full card number) as confirmation of card ownership.
  • The Winner will be announced on 30th May 2026

3. The prize for the Promotion

  • Participants will stand a chance to win the following prize package ("Prize") for two (2) persons (the Winner and one travel companion of the Winner's choice):

The package for two (2) includes:

  • Tickets to FIFA World Cup 26™
  • Hotel accommodation
  • Airport transfers
  • Daily breakfast 
  • Transportation to all FIFA activities
  • Gift card
  • Visa Everywhere Lounge
  • Visa Concierge is located at the hotel.

The package excludes:

  • Travel visa application fees
  • Any meal, event and/or activity outside of the scheduled program itinerary
  • Hotel incidentals (e.g., phone, mini-bar, laundry, etc.)
  • Any applicable taxes
  • The total estimated value of the Prize is approximately R[insert value]. The Prize is valid for use during the FIFA World Cup 26™ tournament period only. Specific travel dates will be confirmed with the Winner upon prize acceptance.

4. Winner’s selection methodology:

The prize winner ("Winner") will be selected by means of a random computerised draw on 1st of June 2026

  • The draw will be conducted under the supervision and certification of an independent external auditor appointed in accordance with Clause 7 below. The random draw process will be remotely witnessed, certified, and recorded by the appointed independent auditor/attorney in South Africa, who will issue a written certificate of compliance confirming that the draw was conducted fairly, randomly, and in accordance with these T&Cs and the CPA.
  • Once the Winner is selected, the details of the winner will be sent to Publicis Machine agency who will get in touch with the Winner (and the Winner’s travel companion of choice)_to arrange when the prize will be made available based on FIFA issuing the tickets, which will be couriered directly to them.
  • The Winner's travel companion will be required to read, understand, and sign a separate Companion Participation Agreement prior to receiving any component of the Prize. The Companion Participation Agreement contains terms and conditions applicable to the companion's participation in the Prize, and a copy of same will be made available to the Winner and companion upon selection.
  • The companion's agreement to those terms is voluntary; however, failure to agree will result in the Winner being entitled to nominate an alternative companion, subject to Visa's reasonable approval. 5. Publication of winners, acceptance and delivery of Prize(s)

  • The Prize will be delivered to the Winner (and the Winner’s travel companion) once all required details have been shared.
  • Delivery will be dispatched, and courier representative will be required to take a picture of the Winner  (and the Winner’s travel companion) with the prize as proof of delivery. Prize delivery costs will be borne from the agency.
  • Once the Prize (including all physical components thereof) has been delivered to and received by the Winner, the Winner accepts all risk associated with the physical Prize items.
  • The Promoter shall take reasonable steps to ensure that the Prize is delivered safely and in good condition.
  • Visa and/or Promoter shall not be liable for any loss, damage, or injury that occurs after the Prize has been delivered to and received by the Winner, provided that such loss, damage, or injury was not caused by any act or omission of Visa and/or Promoter.
  • Nothing in these T&Cs shall limit or exclude Visa 'and/or Promoter’s liability for:
    • death or personal injury caused by their negligence;
    • fraud or fraudulent misrepresentation by Visa and/or Promoter; or
    • any matter in respect of which it would be unlawful for Visa and/or Promoter to exclude or limit liability under the Consumer Protection Act 68 of 2008 or any other applicable law.
  • All risk in and to the Prize shall automatically pass onto the Winner immediately upon receiving the FIFA World Cup 26™  tickets, where after the Winner shall be solely liable (and responsible) for all kinds of risks associated with ownership of the Prize, including (without limitation) the risk of loss and/or damage to the Prize.
  • The Promoter reserves the right at its discretion to conduct a redraw should it, for any reason whatsoever, and after three (3) attempts within 48 hours, prove futile to reach the initial winner on their telephone number.
  • In the event that the Promotor is unable to reach the initially selected Winner after three (3) contact attempts made at reasonable intervals within 48 hours of the Draw Date, using the contact details provided during registration, the Promoter reserves the right to conduct a redraw to select an alternative winner.
  • Prior to conducting a redraw, the Promoter shall make reasonable additional efforts to contact the initially selected Winner, including by email to the address provided during registration, and by leaving a voicemail message where possible.
  • Where a redraw is conducted, the initially selected Winner shall forfeit their entitlement to the Prize solely on account of being unreachable after the contact attempts described above. This forfeiture does not affect any other rights the initially selected Winner may have under the Consumer Protection Act 68 of 2008.
  • Notwithstanding the above, no participant irrevocably waives any rights conferred upon them by the Consumer Protection Act 68 of 2008 or any other applicable legislation by virtue of participating in this Promotion.

6. Independent auditing

  • In accordance with Regulation 11(2) of the Consumer Protection Act Regulations, the Promoter shall appoint a suitably qualified, independent external auditor ("Independent Auditor") for this Promotion. The Independent Auditor may:
    • be a registered auditor in terms of the Auditing Profession Act 26 of 2005, who has no connection, affiliation, or relationship with Visa, Publicis Machine, or any of their subsidiaries, affiliates, directors, officers, or employees;
    • be an admitted attorney with the Legal Professions Council who has no connection, affiliation, or relationship with Visa, Publicis Machine, or any of their subsidiaries, affiliates, directors, officers, or employees; and
    • be appointed prior to the commencement of the Promotion Period.
  • The Independent Auditor shall:
    • oversee and certify the random draw process on the Draw Date; 1st of June 2026
    • confirm that the draw was conducted fairly, transparently, and in accordance with these T&Cs and the CPA;
    • issue a written certificate of compliance within five (5) business days of the Draw Date; and
    • retain all records relating to the draw for a minimum period of three (3) years.
  • The draw shall be witnessed, certified, and recorded by the Independent Auditor at the following address in South Africa:

7. Additional rules for the Promotion

  • Participation in this Promotion is free with no Promotional costs incurred.
  • Entry validation will be verified by confirming that the participant has:
    • registered on visa.co.za/TapiVisaUvaye during the Promotion Period, providing their first name, last name, email address, mobile phone number, and the last four (4) digits of their Visa card number;
    • made a minimum of five (5) qualifying Visa card transactions, each for an amount of no less than R1,500.00, during the campaign 15 May – 23 May 2026 at 23h59 (retained proof of each qualifying transaction).
  • Entries, which are not registered via Visa’s registration entry mechanism or contain errors  will be declared invalid. Any technical failures that lead to any promotional competition entry being invalid or not received will not be for Visa and/or Promoter’s liability, and Visa and/or Promoter will not be held responsible for technical errors.
  • No cash or other alternatives can be offered as a substitution (in whole or part) in lieu of specific prizes, and the prizes are non-transferable.
  • Entry is not open to any director, member, partner, employee, agent of, consultant to, lessee of, sub-lessee of, (employee of such lessee/sub-lessee), spouse of or anyone associated with or affiliated to Visa.
  • Promoter’s operational decisions regarding the administration and draw of this Promotion are final, subject always to participants' rights under the Consumer Protection Act 68 of 2008. Participants who are dissatisfied with any decision or outcome of this Promotion retain the right to:
    • refer a dispute to the National Consumer Commission;
    • approach the Consumer Goods and Services Ombud; or
    • refer a matter to the Consumer Tribunal or a Consumer Court,
    • all in accordance with Chapter 7 of the Consumer Protection Act 68 of 2008.
  • Should the main prize winner not be contactable, Promoter reserves the right to draw a second winner for the purposes of prize fulfilment.
  • The Winner accepts the Prize at his/her own risk and VISA and/or Promoter will not be liable for any costs incurred by the Winner in claiming their prize.
  • Visa and/or Promoter shall not be liable for any loss, injury, or damage sustained by the Winner or companion during their use and enjoyment of the Prize, save where such loss, injury, or damage is directly caused by the negligence, fraud, or wilful misconduct of Visa and/or Promoter. Nothing in these T&Cs limits Visa and/or Promoter’s liability where such limitation would be unlawful under the Consumer Protection Act 68 of 2008.
  • Participants agree to indemnify and hold harmless Visa, Promoter, and their respective affiliates, directors, officers, employees, and agents against any third-party claims arising directly from a participant's own wilful misconduct or gross negligence in connection with their participation in this Promotion or use of the Prize.
  • This indemnity does not extend to, and participants are not required to indemnify Visa and/or Promoter or any associated party against:
    • any claim arising from their own negligence, misrepresentation, fraud, or wilful misconduct;
    • any claim arising from a defect in the Prize; or
    • any matter in respect of which indemnification is prohibited by the Consumer Protection Act  68 of 2008 or any other applicable legislation.
  • Nothing in this clause constitutes a waiver by any participant of any right conferred upon them by the Consumer Protection Act 68 of 2008.

8. Termination

  • Visa reserves the right to suspend, modify, or terminate this Promotion in the following circumstances:
    • where required by a change in applicable legislation or a binding regulatory directive;
    • where continued operation of the Promotion becomes impossible due to circumstances beyond Visa's reasonable control (force majeure), including but not limited to acts of God, national disasters, government restrictions, or the cancellation of the FIFA World Cup 26™; or
    • where there is evidence of fraud, tampering, or abuse of the Promotion that materially undermines its integrity.
  • In the event of termination or suspension as stated above:
    • Promoter shall provide participants with a minimum of 48 (forty-eight) hours' written notice of such termination or suspension, communicated via email, except where immediate termination is required by law or regulatory directive;
    • Promoter shall use reasonable endeavours to draw a winner prior to termination where the Promotion Period has already commenced and valid entries have been received; and
    • participants shall retain all statutory rights conferred upon them by the Consumer Protection Act 68 of 2008, notwithstanding the termination of the Promotion.
  • No participant is required to waive any statutory right as a condition of participation in or as a consequence of the termination of this Promotion. Any such waiver purported to be required by these T&Cs shall be void and unenforceable to the extent that it conflicts with the Consumer Protection Act 68 of 2008.

9. DATA PROTECTION AND PRIVACY

  • Promoter collects and processes participants' personal information for the purposes of administering this Promotion, verifying entries, contacting the Winner, and complying with applicable legal obligations.
  • By participating in this Promotion, participants consent to the collection, use, and processing of their personal information as described in these T&Cs and in accordance with Visa's Global Privacy Notice, available at [insert URL].
  • Promoter shall process all personal information collected in connection with this Promotion in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA"). Promoter shall:
    • collect only the minimum personal information necessary for the purposes of this Promotion;
    • store all personal information securely and protect it against unauthorised access, loss, or misuse;
    • not share personal information with any third party except Publicis Machine (for the purpose of prize fulfilment) and as required by law; and
    • retain personal information only for the period necessary for the purposes described herein, or as required by applicable law.
  • Participants have the right to:
    • access their personal information held by Promoter;
    • request the correction or deletion of their personal information;
    • object to the processing of their personal information; and
    • lodge a complaint with the Information Regulator (South Africa) at [email protected].

10. GENERAL

  • These T&Cs are governed by the laws of the Republic of South Africa.
  • These T&Cs shall be interpreted in a manner consistent with the Consumer Protection Act 68 of 2008. In the event of any conflict between these T&Cs and the CPA, the provisions of the CPA shall prevail.

  • This Promotion is subject to the rules and regulations of the FIFA World Cup 26™. In the event that the FIFA World Cup 26™ is cancelled, postponed, or materially altered, Promoter shall notify participants as soon as reasonably practicable and shall endeavour to offer a reasonable alternative arrangement, subject to feasibility and available resources.
